Terms of Service

Overview

Apex Dynamics (“we,” “our,” “the platform”) is a marketplace and networking platform that connects badminton coaches with students and supports community events, leagues, and challenges. By using our platform — whether as a coach, a student, an event organizer, or a visitor — you agree to these Terms of Service. If you do not agree, do not use the platform.

User Content & Conduct

You are responsible for all content you post, submit, or transmit through the platform, including profile information, booking messages, reviews, ratings, comments, event results, and any other user-generated content (“User Content”).

By submitting User Content you represent and warrant that:

  • You own or have the right to submit the content.
  • The content is accurate to the best of your knowledge.
  • The content does not infringe any third-party intellectual property, privacy, or other rights.
  • The content is not defamatory, harassing, threatening, obscene, or unlawful.

You grant Apex Dynamics a non-exclusive, royalty-free, worldwide license to store, display, and moderate your User Content solely for the purpose of operating and improving the platform. You retain ownership of your content.

Reviews & Ratings

Students and coaches may submit ratings (1–5 stars), public comments, and private notes after a completed lesson. By submitting a review or rating you agree that:

  • Your submission reflects your honest, first-hand experience. You must not submit reviews for sessions you did not personally participate in, or submit reviews for compensation, under duress, or in bad faith.
  • Public comments must not be defamatory, harassing, threatening, or otherwise unlawful.
  • You will not post content that reveals personal information about another user beyond what is relevant to the lesson experience.

Disclaimer. Reviews and ratings reflect the personal opinions of the individual user who submitted them. They do not represent the views, endorsement, or findings of Apex Dynamics. We do not independently verify the accuracy of any review or rating. We reserve the right to remove any review that we determine, in our sole discretion, violates these Terms or is otherwise harmful to users or the platform, but we are under no obligation to do so.

Public comments are currently stored but not displayed publicly. We may display them in the future; we will update these Terms before doing so.

Account & Content Moderation

We operate a community standards and moderation system. Users may report other users for conduct that violates these Terms. Reports are reviewed by platform administrators.

Strike system

When an administrator approves a conduct report, the reported account may receive a “strike.” Accumulated strikes may result in automatic account restrictions or suspension. A lighter-weight “cancellation dispute” process applies to disputed lesson cancellations and carries a reduced penalty compared to a full conduct report. Specific strike thresholds and the consequences of each level are published in our Community Standards page and may be updated from time to time.

Appeals and rebuttals

If your account receives a strike or restriction, you may submit a rebuttal or appeal through the platform. We will review appeals in good faith and notify you of the outcome. We aim to respond to appeals within a reasonable time, but we do not guarantee a specific response window during the beta period.

Important disclaimers

  • Platform moderation is an operational function conducted at our discretion. It is not a legal adjudication, determination of fault, or finding of fact. A moderation decision does not constitute an admission of liability by any party or a finding that any person acted unlawfully.
  • We reserve the right to suspend, restrict, or terminate any account that we determine, in our sole discretion, to be in violation of these Terms, harmful to other users, or otherwise inconsistent with the spirit of the platform — with or without prior notice, depending on the severity of the conduct.
  • To the maximum extent permitted by law, Apex Dynamics is not liable for any harm arising from moderation decisions made in good faith, including account suspensions, content removals, or strike issuances.

Moderation records

We retain records of reports, strikes, rebuttals, and appeal outcomes beyond standard account-deletion retention periods where necessary to enforce platform rules, protect other users, or defend against claims.

Communications

By creating an account you agree to receive transactional emails from Apex Dynamics, including booking confirmations, lesson reminders, event updates, and account and security notifications. These messages are part of the service and are not subject to marketing opt-out, though you may adjust which transactional notifications you receive in Account > Notification Preferences.

We may also send you optional marketing emails (product newsletters, new-feature announcements). We will only send marketing emails with your consent. You may withdraw consent at any time by:

  • Clicking the one-click unsubscribe link in any marketing email; or
  • Visiting Account > Notification Preferences in the platform; or
  • Emailing privacy@apexdynamics.app.

We will honor opt-out requests within ten business days. Opting out of marketing emails does not affect transactional messages. All commercial emails from us will identify Apex Dynamics as the sender and include a valid postal address as required by applicable law.

In-app inbox

Platform administrators and authorized event or group organizers may send messages to your in-app inbox. There is no user-to-user messaging via the inbox. All inbox messages are automatically deleted 30 days after delivery. You acknowledge that inbox messages are an operational communications channel and that important account-related notices may be delivered via email as well.

Platform-Only Role, Release & Waiver, and Limitation of Liability

Platform-only role. Apex Dynamics solely provides a platform and technology service to connect people. It does NOT organize, host, supervise, control, endorse, or vet any event, group, clinic, host, coach, or participant. Where an explicit “Verified” badge is shown, it reflects a limited courtesy review only and is not a guarantee of safety, accuracy, or fitness. Apex Dynamics is not a party to any arrangement, interaction, or activity that takes place between users.

Assumption of risk. By registering for or joining any event or group, you voluntarily choose to participate and you assume all risks associated with participation, including but not limited to physical injury, illness, death, property loss or damage, and any disputes, harmful interactions, or other harm involving other participants, organizers, or third parties.

Release and waiver of claims. To the fullest extent permitted by applicable law, you hereby release, waive, and dischargeApex Dynamics and its owners, operators, officers, employees, and affiliates (collectively “Apex Dynamics”) from any and all claims, liabilities, losses, damages, costs, or causes of action — known or unknown, in law or in equity — arising out of or related to your participation in any event or group, your interactions with other users, or your use of the platform.

Indemnification.You agree to indemnify and hold harmless Apex Dynamics from any claim, loss, damage, or expense (including reasonable attorneys’ fees) arising out of your participation, your conduct, or any breach of these Terms. Hosts/organizers additionally agree to indemnify Apex Dynamics from any claim arising out of their event, group, or actions as organizer.

Host responsibility. The host/organizer is solely responsible for their event or group: its safety, compliance with all applicable laws and regulations, any required permits or permissions, and the conduct and well-being of all participants. Apex Dynamics bears no supervisory, organizational, or liability role.

No warranty / “as is.” The platform and all content, listings, and other users are provided “as is” and “as available.” Apex Dynamics makes no warranties — express or implied — and is not responsible for the accuracy of listings or the conduct, identity, qualifications, or fitness of any user.

Limitation of liability.To the maximum extent permitted by applicable law, Apex Dynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including physical injury, illness, death, property damage, loss of profits, or any other harm — arising out of or related to any event, group, or other activity facilitated through the platform, even if Apex Dynamics has been advised of the possibility of such damages. Apex Dynamics’s total aggregate liability for any claim shall not exceed USD $100.

Events, Leagues, Challenges & Standings

The platform allows users to create, join, and organize events, leagues, and challenges. Organizers may record match or session results that feed publicly displayed standings and rankings.

  • Organizer responsibility. Organizers are solely responsible for the accuracy of results they enter. Apex Dynamics does not independently verify event results, standings, or rankings.
  • No guarantee of accuracy. We make no representation that standings or results are accurate, current, or complete. Users who believe a result has been entered in error should contact the event organizer directly or report the issue to us.
  • Data usage. By participating in an event, you acknowledge that your results (name and score/placement) may be displayed publicly on the platform as part of standings and leaderboards.
  • Event cancellation. We are not responsible for events that are cancelled, rescheduled, or otherwise modified by organizers.

No Warranty

The platform is provided “as is” and “as available,” without warranty of any kind, express or implied. We do not guarantee uptime, accuracy of any coach or student information, accuracy of reviews or ratings, accuracy of event results or standings, lesson quality, or fitness for any particular purpose. User-generated content — including reviews, ratings, event results, and profile information — is provided by users and not verified by us.

Lesson Safety

Physical activity carries inherent risk. By booking or conducting a lesson through Apex Dynamics, you acknowledge that you assume full responsibility for your own safety and the safety of participants in your care. Coaches are solely responsible for conducting lessons safely and in compliance with applicable laws. Students and parents/guardians are responsible for ensuring participants are medically fit to participate.

Apex Dynamics is not present at lessons and has no ability to supervise or control what occurs. We are not liable for any injury, illness, property damage, or other harm arising from lessons arranged through the platform.

No Background Checks

We do not conduct criminal background checks, identity verification, or professional-license verification on coaches or students. You are responsible for performing your own due diligence before agreeing to meet or conduct lessons with any user. We strongly encourage coaches and students/parents to communicate thoroughly before booking.

Payments

Payment processing is not currently handled by the platform. Any payment arrangements are made directly between coaches and students. We are not responsible for payment disputes, refunds, or non-payment. This section will be updated when in-platform payments are introduced.

Dispute Resolution

Disputes between coaches and students are the sole responsibility of the parties involved. We may, at our discretion, assist in mediating disputes, but we have no obligation to do so and our assistance does not create liability on our part.

Limitation of Liability

To the maximum extent permitted by law, Apex Dynamics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or personal injury, arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages. This limitation applies, without limitation, to:

  • Content posted by other users, including reviews, ratings, or comments about you.
  • Moderation decisions, account restrictions, or account suspensions.
  • Inaccuracies in event results, standings, or rankings.
  • Failure to deliver or delayed delivery of email communications.
  • Automatic deletion of in-app inbox messages after 30 days.

Our total aggregate liability for any claim shall not exceed USD $100.

Changes to These Terms

We may update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. We will update the “Last updated” date at the top of this page.
